{"id":9966,"date":"2025-05-20T08:12:00","date_gmt":"2025-05-20T13:12:00","guid":{"rendered":"https:\/\/cdes.org.ec\/webantigua\/?p=9966"},"modified":"2025-05-20T08:24:58","modified_gmt":"2025-05-20T13:24:58","slug":"comunicado-rechazamos-el-proyecto-de-ley-economico-urgente","status":"publish","type":"post","link":"https:\/\/cdes.org.ec\/webantigua\/comunicado-rechazamos-el-proyecto-de-ley-economico-urgente\/","title":{"rendered":"COMUNICADO: RECHAZAMOS EL PROYECTO DE LEY ECON\u00d3MICO URGENTE"},"content":{"rendered":"<h2>PORQUE NO DESARTICULA EL CRIMEN ORGANIZADO SINO QUE REFUERZA EL AUTORITARISMO DE LA \u00c9LITE ECON\u00d3MICA (\u00bfY EL NARCOPODER?)<\/h2>\n<p><span style=\"font-weight: 400;\">El proyecto de \u201cLey para Desarticular la Econom\u00eda Criminal\u201d <\/span><b>no ofrece soluciones reales,<\/b> <b>no es de urgencia econ\u00f3mica<\/b><span style=\"font-weight: 400;\">, <\/span><b>y atenta gravemente contra derechos constitucionales<\/b><span style=\"font-weight: 400;\">,<\/span> <span style=\"font-weight: 400;\">porque:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Permite allanamientos sin orden judicial, violando la <\/span><b>inviolabilidad del domicilio<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Introduce la categor\u00eda de \u201csospechoso\u201d u \u201cobjetivo militar\u201d, vulnerando la <\/span><b>presunci\u00f3n de inocencia<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Autoriza incautaciones sin sentencia ni control judicial, atentando contra el <\/span><b>derecho a la propiedad<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Aumenta penas sin sustento, reforzando un <\/span><b>populismo penal ineficaz<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Crea tribunales de excepci\u00f3n (\u201cjueces de conflicto armado\u201d), prohibidos por la Constituci\u00f3n.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Otorga al Presidente atribuciones operativas sobre allanamientos y confiscaciones, violando el principio de <\/span><b>separaci\u00f3n de funciones<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Faculta al Presidente dar <\/span><b>indultos anticipados<\/b><span style=\"font-weight: 400;\"> a personas procesadas penalmente por hechos vinculados al conflicto armado interno, incluso sin sentencia condenatoria. <\/span><b>Lo que abre la posibilidad de la impunidad en abusos de la fuerza p\u00fablica.<\/b><\/li>\n<\/ul>\n<p><b>En lugar de un Estado policial, proponemos medidas reales contra las econom\u00edas criminales que operan principalmente desde el poder pol\u00edtico y econ\u00f3mico:<\/b><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><b>Fortalecer la UAFE y la Fiscal\u00eda<\/b><span style=\"font-weight: 400;\">, con unidades especializadas en lavado de activos y crimen financiero.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><b>Investigar flujos il\u00edcitos<\/b><span style=\"font-weight: 400;\"> y estructuras opacas de grupos econ\u00f3micos, bancos, agroexportadoras y mineras.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><b>Reformar el sistema tributario<\/b><span style=\"font-weight: 400;\"> para impedir el blindaje legal de grandes patrimonios il\u00edcitos.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><b>Controlar estrictamente la salida de divisas y comercio exterior<\/b><span style=\"font-weight: 400;\">, investigando sobrefacturaci\u00f3n, triangulaci\u00f3n y uso de para\u00edsos fiscales.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><b>Modernizar y fortalecer el control aduanero<\/b><span style=\"font-weight: 400;\">, con trazabilidad de carga, inteligencia financiera y depuraci\u00f3n institucional.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><b>Desarrollar estrategias econ\u00f3micas en territorios capturados por el narco<\/b><span style=\"font-weight: 400;\">, basadas en empleo, cr\u00e9dito comunitario y sustituci\u00f3n productiva.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Y, muy importante, <\/span><b>garantizar transparencia patrimonial de autoridades p\u00fablicas y jueces<\/b><span style=\"font-weight: 400;\">.<\/span><\/span><\/li>\n<\/ol>\n<p><b>La seguridad requiere combatir los principales poderes que lideran la econom\u00eda criminal.
